Introductory provisions
- MEGANET d.o.o., D. Bazjanca 29, Zagreb, Croatia – an owner of iOS and Android smartphone apps and internet pages related to them. (hereinafter: MEGANET)
- User – each person who uses these iOS and Android smartphone apps and internet pages related to same smartphone apps.
- www.meganet.hr – an Internet page which provides a possibility of using various contents and services to its users in accordance with the conditions which are determined here. (hereinafter: Meganet “ Internet page” or “this Internet page”)
1. Meganet d.o.o. smartphone apps start package can be used free of charge. However, there's an additional packages which are available through in-app purchase. Internet pages related with same smartphone apps are free to use.
2. Meganet d.o.o. as an owner of these smartphone apps and internet pages related to same smartphone apps, retains the right not to be available to users due to various technical difficulties which might be out of control of the personnel and the representatives.
3. Meganet d.o.o. as an owner of these smartphone apps and internet pages which are in any way related to same smartphone apps, retains the right to change the conditions for use without previous announcement.
4. The usage of the Meganet d.o.o. smartphone apps and internet pages related with same smartphone apps is subject to the acceptance of these conditions for use. Meganet d.o.o. as an owner of smartphone apps and internet pages related with same smartphone apps, is not responsible if the user does not understand the language in which these conditions for use are written or does not understand the contract as such. Meganet d.o.o. as an owner of these smartphone apps and internet pages related with same smartphone apps is not responsible if the user does not have a business ability for concluding the contract. The user confirms by accepting of these conditions that they have a business ability for concluding the contract.
DATA WE COLLECT
This document explains how Meganet d.o.o. collects, processes, stores and/or shares any personal data and/or information from users (jointly referred to as “Information”). By accessing and/or using the Services user is consent the collection, transfer, manipulation, storage, disclosure and other uses of your information as described in this Privacy Policy. If you have any concerns about providing data, or having it used in any manner permitted in this Privacy Policy, you should not use the Services. As set out in the terms and conditions relating the Services (the “Terms”), you must be at least at legal age to access and/or use the Services, or if legally possible, to access with your legal guardian consent, due authorization and agreement with these Privacy Policy.
Meganet d.o.o. may collect and process the following data about you: information that you provide when you fill in forms when accessing and/or using the Services, or when you create an account within the Services; details of your use of the Services and the resources that you access; the correspondence between you and Meganet d.o.o. and any interactions, or with other users on the Service, the channels and/or any social media related; from third parties who hold data about you and who agree to share this data with us; and information collected via cookies and other similar technologies and/or other mechanisms, as explained further below.
Payment information: If you make a purchase in the Services, Meganet d.o.o. may collect the billing and financial information necessary to process the charges; and/or do so on behalf of the relevant payment service providers. Purchases of third party services are subject to the policies applicable to such provider.
Third-party services: Meganet d.o.o. uses a variety of third-party services to help its provision of the Services, such as hosting and other services. These third-party service providers may collect information sent by your browser as part of a web page request, such as cookies or your IP address. Also, third-party ad partners may share information to measure ad quality and tailor ads, for example to display ads about things you may have already shown interest in.
Information You Provide via Mobile Applications: You may have the option to link your Mobile account to your Site account in certain Mobile Applications. This will allow you to participate in content that crosses between the Site and Mobile apps and games, such as new Meganet d.o.o. apps and updates. If you choose this linking option the information we receive via the Site may also apply to Mobile Applications, and information we receive via your Mobile account may also apply to your usage of the Site and your Site account.
Information We Receive Through Mobile Applications: If you use a Meganet d.o.o. app on a mobile device (such as your phone or tablet) we can collect mobile device identifiers that can include things like your MAC address and IP address. We may also collect information such as device name and type, operating system, telephone number, country, and any other information you choose to provide such as your game character name or e-mail address. Additionally, we may access third party information such as your phone or Facebook contacts provided you allow your device to connect to services and you have given the application permission to access this information. We may only collect this information with your authorization and according to the rules you have established within your device permissions.
Mobile Application Notifications: With your consent, Meganet d.o.o. mobile applications may send push notifications to your mobile device to provide game information, news, updates, or other relevant information. You can manage these updates from the ‘options’ or ‘settings’ page from within the Mobile Application or from your device control panel that manages these notifications.
Invite a Friend: You may invite friends to join the Meganet d.o.o. use smartphone apps and internet pages related to same smartphone apps by using the "invite a friend" feature. You will be required to submit your name and email address, as well as their name and email address. Your friend's personal information that you submit in this feature will be used only to send the email you request, and will not be otherwise stored or maintained by Meganet d.o.o.
Your Location Information: You may choose to publish your location while you using smartphone apps and internet pages related with same smartphone apps owned by Meganet d.o.o. You may also tell your location when you enable your device to send such location information. Meganet d.o.o. may use and store information about your location to provide special features and/or to improve and customize the Services.
Customer Support Correspondence: When you ask for assistance from Meganet d.o.o. customer support, the contact information you provide will be collected, as well as information about your game play or activity on the Service, your user ID number, and the correspondence and any information contained within. If available through the Services, you may provide Meganet d.o.o. with profile information to make public, such as a short biography, location, website, cell phone, a picture, information to customize your account, etc. Such contact information may be used to send you information about the Services or related information. You may use your account settings to unsubscribe from notifications from Meganet d.o.o. and/or from other users and find users you know. You may also unsubscribe by following the instructions contained within the notification or the instructions on the Service. Also Meganet d.o.o. may use your contact information to help others find your account, including through third-party services and client applications. Providing any additional information described in this section is entirely optional.
Do Not Track: Do Not Track (DNT) is a privacy preference that users can set in their web browsers, allowing users to opt out of tracking by websites and online services. At the present time, the World Wide Web Consortium (W3C) has not yet established universal standards for recognizable DNT signals, and, therefore, Meganet d.o.o. does not recognize DNT.
COOKIES
The Services may use “cookies” and other technologies such as pixel tags, local shared objects, hardware-based device identifiers, Operating System-based identifiers, clear GIFs and web beacons. Meganet d.o.o. treats information collected by cookies and similar technologies as non-personal data.
A “cookie” is a small file stored by your browser when told to do so by a website. Typically websites place a number of different cookies on an end-user’s machine. Some of the cookies are “1st Party,” from the website itself, and others are “3rd party,” belonging to advertising and analytics entities or social networks. Meganet’s cookies do not include personal data and are typically used to quickly identify your device and to “remember” your browser during subsequent visits for purposes of functionality, preferences, and website performance. You can disable cookies or set your browser to alert you when cookies are being sent to your device; however, disabling cookies may affect your ability to use the Services.
Flash cookies & HTML5: Meganet d.o.o. may also use Flash cookies (local shared objects) and HTML5 local storage. Flash cookies are small files similar to browser cookies, but which are not stored in the browser and can also be used to remember your settings, to personalize the look and feel of the Services, or for advertising and analytics. You may prevent Flash cookies from being stored by following the instructions provided by Adobe at http://helpx.adobe.com/flash-player/kb/disable-local-shared-objects-flash.html.
Web Beacons and pixel tags: A “web beacon” or a “pixel tag” is an electronic image (often not visible to the end-user) that allows Meganet d.o.o. to count users who have visited certain pages or viewed certain advertisements. Additionally, e-mails and other electronic communications Meganet d.o.o. sends to you may contain pixel tags that enable Meganet d.o.o. to track your usage of the communication, including whether the communication was opened and/or what links were followed, if any.
USING COLLECTED INFORMATION
When you create or configure an account in the Services, you provide some personal information, such as your name, username, password, and email address. Some of this information, for example, your name and/or username, may be listed publicly on the Services, including on your profile page and in search results. You agree that Meganet d.o.o. and/or third parties on its behalf and/or its partners may use the Information for the purposes of contacting you as part of customer support; to send you updates or information about the Services; managing your account and relationship with the Service and improving your experience when you use it, improving the Services, research, surveying, and engaging with you, for example by sending you communications for these purposes; marketing and promotion of the Services or products; to personalize and optimize the Services, promotional content and/or advertising; to create reports, analysis or similar services for the purposes of research or business intelligence.
We may also combine the information you submit to us with information we have collected from you in other forums, such as through emails or offline, or with publicly available information or information we obtain from third parties. When so combined, we or our business partners may use the combined information to make offers to you that we believe may be of interest to you.
WHEN WE MIGHT DISCLOSE INFORMATION
As part of our regular business conduct, we may share information with companies or individuals providing services or acting on our behalf, such as companies providing technological or fulfillment services or acting as our marketing partners. In the event that there is a change of corporate ownership, the new owners will of course be provided with our files, including information you have submitted. We will provide information in response to subpoenas, and we also will share information with government officials, including law enforcement officials or court authorities, in order to initiate or cooperate with any law enforcement or governmental investigation.
Unless we tell you first (such as at the time we collect information from you), or unless it is part of a specific program or feature in which you have elected to participate, we do not share personally identifiable information that we have collected (such as name or email address) with other, third-party companies for their own commercial or marketing purposes
Meganet d.o.o. will only share your data with third parties with your consent (including as set out in this Privacy Policy), as reasonably necessary in order to provide the Services, for example, by providing Information to suppliers that Meganet d.o.o. may use to fulfill the Services; where it is necessary to carry out your instructions, for example, to process a payment instruction your Information has to be provided to the payment processors; where your data is on an anonymous and aggregated basis, meaning you could not be personally identified from it; when you submit information as part of a competition or otherwise interact with any channel or social media, the information you submitted may be published; as its reasonably believed is permitted by law or regulation; in order to comply with any legal obligation, or in order to enforce or apply the Terms, this Privacy Policy and/or any other agreement with you; or to protect the rights and/or property of Meganet d.o.o. or third-party´s rights and/or property. Meganet d.o.o. may share or disclose your non-private information, such as public user profile information, public messages, e-mail, etc., or share or disclose your information in an anonymous or aggregated basis in a manner that does not allow your personal identification.
INTERACTION WITH SOCIAL NETWORKS AND/OR PLATFORMS
You may allow the Services to interact with any third party social network and/or platforms, such as Facebook, which will provide data about you to Meganet d.o.o. Since any others applications or websites different than the Services are owned by a third party, you must ensure that you read their terms of service and the applicable privacy policies. You understand that when you allow the Services to interact with any third party social network and/or platform, Meganet d.o.o. may share data about you with your contacts and other users of the Services and vice versa. This Data may include your name, profile picture, activity status, and information related to your use of the Services. You can change this by adjusting your settings with that third party provider.
ADVERTISING
Meganet d.o.o. reserves the right to use and disclose the collected, non-personal data for purposes of advertising by Meganet d.o.o. or Meganet’s partners and contractors.
Meganet d.o.o. may employ third party ad serving technologies that use certain methods to collect information as a result of ad serving through Services.
Meganet d.o.o. or third parties operating the ad serving technology may use demographic and geo-location information as well as information logged from your hardware or device to ensure that relevant advertising is presented within the Service. Meganet d.o.o. or third parties may collect and use data, for such purposes, including but not limited to, data such as IP address, Device ID, MAC address, installed software, application usage data, hardware type, Operating System information, browser information, unique identifiers in browser cookies, Flash cookies, and HTML5 local storage, Internet and on-line usage information and in-game or in-app information.
The foregoing data may be used and disclosed in accordance with this Privacy Policy and the privacy policy of the company providing the ad serving technology.
Meganet d.o.o. may display to you behaviorally targeted advertising. If you wish to "opt out" of certain targeted advertising, please visit http://www.youradchoices.com and/or www.networkadvertising.org. Please note that the links above may not reach all Meganet’s advertising partners and certain behaviorally targeted advertising may still be displayed to you. If you want to be certain that no behaviorally targeted advertisements are displayed to you, please do not use or access the Services.
Some services may include the use of in-game advertisements or brand placement. Such ads or sponsorships will be noted as such within the services.
Additionally please note that if you “opt out” it does not mean that you will no longer receive advertising. It just means that the advertising you see displayed will not be customized to you and your interests and may be less relevant to you.
Advertisers on mobile devices sometimes use advertising identifiers to enable and optimize their advertising. These identifiers are non-permanent, non-personal, device identifiers. Meganet d.o.o. may use your device’s advertising identifier and other information associated with it, to deliver ads that relate to your interests and to improve and measure the effectiveness of ad campaigns.
CHILDREN'S PRIVACY
The Site and Mobile Applications are designed for and directed at people 18 years of age or older. We do not knowingly collect information from children under 13. If Meganet d.o.o. learns that a child under the age of 13 has submitted personally identifiable information online in contravention of these measures, it will terminate access to the account immediately and will take all reasonable measures to delete such information from its databases and to not use such information for any purpose (except where necessary to protect the safety of the child or other as required or allowed by law). PURCHASE CONDITIONS
These conditions determine the ordering procedure, payment, delivery and complaint of the products which are offered on these pages. Meganet d.o.o. smartphone apps and internet pages related to same smartphone apps can be used for your private use without any usage fees, and according to the following conditions and rules.
The seller is the Meganet d.o.o., and the buyer is a visitor of these pages who fills in an electronic order, sends it to the seller and makes payment with a credit card.
PLACING AN ORDER
The buyer orders the product or products by an electronic order form.
The buyer is every person who orders electronically at least one product, fills in required data and sends an order.
All prices are stated in the USD, VAT included. The prices are stated on the copyright work which is sold. The goods are ordered electronically, by clicking on a certain smartphone app additional package. The goods are deemed ordered at the moment when the buyer chooses and confirmed the payment method. The purchased goods will be downloaded, and smartphone app will be updated automatically on a buyer's smartphone or tablet, when the price is paid.
PAYMENT
The buyer can pay the additional packages as follows:
- online by using credit cards.
Online payment with credit cards and an authorization is carried out online at the real time. Online payment is totally safe and protected.

- Cross-Platform Mobile Payments
Meganet d.o.o. shall issue an invoice after the receipt of the payment by the buyer.
RESPONSIBILITY
Meganet d.o.o. does not guarantee:
- for competence and ability of other party for concluding an agreement, correctness, completeness and accuracy of personal data of the user
- that there shall be no errors on the pages and/or that they shall function without interruption at any moment
- that the third party shall legally use these pages all the time.
Meganet d.o.o. is exempted up to the maximal legally permitted liability from any damage, loss or injury which might occur directly or indirectly due to the
Meganet d.o.o. cannot be responsible for any contents shown on the pages of the third parties to which an occasional access can be allowed. Any such access cannot be interpreted in the sense of connection to the Meganet d.o.o. , or supporting of such smartphone apps and internet pages by Meganet d.o.o. This smartphone apps and internet pages can contain links to other pages, but Meganet d.o.o. is not responsible for the services or products which were reached in such a way.
Meganet d.o.o. can be occasionally unavailable due to various technical difficulties.
Meganet d.o.o. is not responsible for any legal procedure or complaint against the user based on the breach of any of the copyrights or intellectual property right.
Meganet d.o.o. is not responsible for damages or losses which occurred by the use of the smartphone apps and internet pages related to them (such as financial losses) which might be caused by the errors on the pages.
Furthermore, Meganet d.o.o. does not give any guarantee for the information which you might find in the announcements or on other pages which you got on the Internet as a result of use of these smartphone apps and internet pages.
You agree that you and Meganet d.o.o. are independent contractors of these Conditions for Use. If you threaten or breach these Conditions for use or any other rights we retain the right to terminate this Contract and initiate criminal proceedings and file charges against you as well as a damage compensation claim. If you do not agree with our conditions for use of the Meganet d.o.o. smartphone apps and internet pages please leave them and do not use our services any more.
In case of any dispute between the Meganet d.o.o. and an individual user or any third damaged party the competent court is the Court in Zagreb, Croatia. If you notice any breach of these Conditions for Use please report it to us.
PREVENTION FROM USE, DAMAGE COMPENSATION
Meganet d.o.o. retains the right to prevent from further use of the pages the user who in any way breaches the Rules and conditions for use, in any way disturbs the work of the pages or in any way offenses the rights of the owner and other users. Meganet d.o.o. retains the right to prevent from further use the user which misuses the published data or in any way uses Meganet d.o.o. smartphone apps and internet pages related to them without authorization, and especially in relation to copying of the contents published on theses smartphone apps and internet pages related to same smartphone apps .
By preventing of such user Meganet d.o.o. can demand a compensation of the damage which includes the material and non-material damage and the loss of profit, all in accordance with the Obligation Act.
